Legal Advisor - Senior
Temporary Position for Legal Counsel at Fiberklaar (FK):
The position reports to the Legal & Regulatory Manager of FK (who in turn reports within the Management Team to the CEO).
The role primarily involves supporting the ongoing negotiations with the Construction Partners (CPs) for the rollout of FK’s fiber network.
There are currently 8 CPs active under a (complex) existing agreement based on the Dutch model. The intention is to reopen and renegotiate these agreements based on experience gained and new strategic decisions.
Some CPs are open to this. Others are initially less or not open to this. With some CPs, the aim is to terminate the agreement (under certain conditions).
For the CPs with whom we will continue to work, the intention is to temporarily maintain the existing complex agreement (as a subordinate document), but to supplement it with:
A settlement agreement for existing points of dispute
A new way of working (in particular, see a program of requirements)
In a second phase, a fully coordinated version is envisioned
For CPs with whom collaboration will cease, the intention is:
To reach a settlement agreement for existing points of dispute
To terminate the existing agreement in such a way that a smooth transition can be ensured with other party(ies) for continued network operations
The role specifically includes the following tasks in this context:
Analysis of potential claims
Advice regarding such potential claims
Support during negotiations of such potential claims
Drafting of contract clauses based on discussions
Discussion of these contract clauses, both internally with various relevant departments (e.g., Procurement, Construction, Finance, Operations, etc.) and externally (e.g., lawyer(s) representing the CPs)
Project management and follow-up on all open points
Clear and simple storage of drafts/comments in systems
Striving for as much consistency as possible across documents for the different parties
Periodic reporting on progress to FK’s Legal & Regulatory Manager, who remains closely involved in the CP project
In addition, the position may support the FK Legal & Regulatory Manager on specific topics such as:
Administrative aspects related to network rollout (e.g., permits, authorizations, etc.)
Procurement files
Litigation or threatened litigation
Requirements for the role:
Master’s degree in law
Minimum 5 years of practical experience
Relevant experience with construction contracts
Contract lawyer
Relevant software knowledge
Fluent in Dutch and English
Team player
Stress-resistant
Structured and methodical
Results-oriented
At least 4/5 availability
Available until the end of 2025 (target completion date for CP project)
Preferably no other professional commitments
Minimum 1 to 2 days per week in the Ghent office
